Changes to the Rehabilitation of Offenders Act 1974
Amendments to the Rehabilitation of Offenders Act 1974 (ROA) came into effect on Monday 10 March.
The amendments relate mainly to the time it takes for an offence to become “spent†under the Act (the rehabilitation period). The rehabilitation periods are being reduced for most offences, which you can view on the guide to changes published by the Ministry of Justice.
Please note:
Please note:
- The amendments relate only to offences in England & Wales – not Scotland.
- The changes do not affect disclosure of road traffic endorsements, due to a savings provision which preserves the existing rules for these offences.
As we look at each risk individually, we will not apply any additional terms or loadings for convictions accidentally disclosed under the old rules.
